I give up. I throw in the Towel. I am joining the other side. After all, if you can’t beat them, join them. My new company will be called Legitimate Claim Funding LLC, or LCF LLC for short. Its sole purpose will be to submit claims in Chapter 13 bankruptcy cases. If Round Up Funding LLC can do it, then so can LCF LLC.
When people file for Chapter 13 bankruptcy, sometimes referred to as debt consolidation or debt reorganization, they are proposing a new repayment plan to their creditors that is more feasible than what their current contractual obligations may impose. If you happen to be the creditor and you want to get paid, you must file a proof of claim. Further, if you file a proof of claim, you must file just that, proof that you are entitled to the claim!
Although I am not a creditor, my new LLC will pretend it’s a creditor and start filing thousands of claims in Chapter 13 cases across the nation. I already have the forms to fill out and access to all the Chapter 13 filings so I can see who I will be submitting my claim on behalf of (the creditors listed in each bankruptcy) Can you say Cha Ching? Time to collect. No you say? I can’t do it? It seems absurd, but yes, it’s already happening.
I see them everyday. Claims submitted to my local bankruptcy court by the zillions of debt buyers with absolutely no proof they are the proper party entitled to be paid. No assignment, no purchase contracts, not even a document explaining what’s going on. They must be raking in the dough. And so what if they get caught once in a while by those Boot Camp lawyers ? Big deal, so I too might get a slap on the wrist or decide to make up some documents. Heck if I got this far what’s to stop me now? Perhaps that little pretty line at the very bottom of every proof of claim that no one ever seems to read, the one that states “Penalty for presenting fraudulent claim: fine of up to $500,000 or imprisonment for up to 5 years, or both. 18 USC 152 and 3571.”
